Patna, July 31, 2026; Political activity in Bihar intensified on Friday after BJP Member of the Legislative Council (MLC) Devesh Kumar resigned from his seat, paving the way for Panchayati Raj Minister Deepak Prakash to potentially enter the Bihar Legislative Council.
Devesh Kumar reached the Bihar Legislative Council through a back entrance on Friday evening and submitted his resignation to Chairman Awadesh Narayan Singh.
Several senior BJP leaders, including State President Sanjay Saraogi, were reportedly present when he tendered his resignation.
Preparation in the NDA is on to send Deepak Prakash to the upper house after Devesh Kumar’s resignation:
Following the resignation of Devesh Kumar, preparations are reportedly underway to nominate Deepak Prakash for the vacant Legislative Council seat.
Deepak Prakash is currently serving as Panchayati Raj Minister in the Bihar government but is not a member of either the Legislative Assembly or Legislative Council.
Under Article 164(4) of the Constitution, a minister who is not a member of either House must secure membership within six months of being appointed to the Council of Ministers.
The issue had generated considerable political controversy, with opposition parties repeatedly questioning how the minister could continue in office without legislative membership.
The matter had also reached the courts, adding to pressure on the state government to resolve the issue.
With Devesh Kumar’s resignation creating a vacant Council seat, the ruling NDA is now reportedly preparing to field Deepak Prakash for the position. If he is elected or otherwise validly appointed to the seat, his membership would address the constitutional requirement concerning his constitution as a minister.
Opposition repeatedly raised the issue:
The opposition had been consistently attacking the government over the issue, arguing that constitutional provisions require a minister who is not already a legislator to become a member of the legislature within the prescribed period. The NDA, meanwhile, maintained that the matter would be resolved in accordance with constitutional and legal provisions.
The resignation of Devesh Kumar is therefore a political and constitutional development. While a formal announcement regarding Deepak Prakash’s candidature is awaited, the move has significantly strengthened speculation that he will soon enter the Bihar Legislative Council.
