Patna, August 5, 2026: Deepak Prakash, son of Rashtriya Lok Morcha (RLM) President Upendra Kushwaha, has been nominated as a member of the Bihar Legislative Council under the Governor’s quota on Wednesday.
Bihar Governor Syed Ata Hasnain has approved the state government’s proposal for his nomination, paving the way for him to formally continue as a member of the state cabinet.
The seat had fallen vacant following the resignation of BJP MLC Devesh Kumar.
Upendra Kushwaha expresses joy over Deepak Prakash’s nomination:
Commenting on his son’s nomination, Upendra Kushwaha said that such a step had become necessary as questions were being raised over Deepak Prakash’s continuation as a minister.
He expressed gratitude to the NDA leadership, including PM Narendra Modi, HM Amit Shah, BJP National President Nitin Nabin, Bihar Chief Minister Samrat Choudhary and Former Bihar Chief Minister Nitish Kumar for resolving the issue.
Deepak Prakash had been serving as a minister in the Bihar government since November 2025, despite not being a member of either the Legislative Assembly of Legislative Council. PIL in the Supreme Court:
The issue came under scrutiny following a Public Interest Litigation (PIL) filed before the Supreme Court.
The court sought the Bihar government’s response regarding the continuation of a minister who had not obtained membership of either House within the prescribed period.
Against this backdrop, BJP MLC Devesh Kumar resigned from the Legislative Council on July 31, 2026, even though his term was scheduled to continue until March 2027.
His resignation created a vacancy that enabled the government to recommend Deepak Prakash’s nomination under the Governor’s quota.
Deepak Prakash will now take the oath of office and secrecy as an MLC, formally securing his position as Bihar’s Panchayati Raj Minister.
