
Patna, June 5, 2025: Leader of Opposition Tejashwi Yadav has written a powerful letter to Chief Minister Nitish Kumar, demanding the immediate convening of a special session of the Bihar Legislative Assembly to pass a bill ensuring 85% reservation in government jobs and educational institutions.
He also urged the state government to send the bill to the Central Government for inclusion in the Ninth Schedule of the Constitution to protect it from judicial scrutiny. Tejashwi Yadav has warned that failure to act on the issue will lead to a massive statewide agitation in support of Bihar’s Dalit, Adivasi, and backward communities.
Tejashwi Yadav highlighted various demands in his letter:
Tejashwi Yadav called for increasing the current 75% reservation (65% for OBC/EBC/SC/ST and 10% for EWS) to 85%, citing socio-economic findings from the 2023 caste-based survey conducted under the Mahagathbandhan government.
He expressed concern over the quashing of the 75% quota law by the Patna High Court on grounds of insufficient data on representation.
Tejashwi Yadav pointed to Tamil Nadu’s 69% reservation, safeguarded under the Ninth Schedule, as a precedent.
The RJD leader proposed the formation of an all-party committee to conduct a study on representation and submit its report within a week, followed by a one-day special Assembly session to pass the bill.
A direct attack on NDA and BJP:
Tejashwi Yadav accused the NDA government of lacking political will and claimed that the BJP-ESS ideology was obstructing increased reservation for marginalized communities.
Doesn’t this NDA government which is running on the policies of Bhartiya Janata Party and RSS, want the deprived classes to get the benefit of increased reservation?” he asked in the letter.
He stressed that after the Assembly passes the bill, it must be immediately sent to the Centre for inclusion in the 9th Schedule, to prevent “anti-reservation forces” from challenging it legally.
Warning of statewide protest:
Tejashwi Yadav warned, “If this is not done within three weeks, a statewide mass movement will be launched in the interest of 90% of the state’s Dalit, tribal, backward-most backward and historically oppressed people.”
The reservation issue has taken center stage in Bihar’s politics after the Patna High Court struck down the expended quota law, citing the lack of quantifiable data.
Tejashwi Yadav claims the jobs and admissions currently underway are bypassing underrepresented communities due to the rollback. He also reminded the Chief Minister that similar demands were made earlier including through an adjournment motion in March 2025 and during the Governor’s address debate in February.
