Patna, March 30, 2026: In a significant political development in Bihar, Chief Minister Nitish Kumar and BJP National President Nitin Nabin resigned from their respective legislative posts on Monday.
Nitish Kumar resigns as MLC, set to join Rajya Sabha:
Chief Minister Nitish Kumar stepped down from his membership of the Bihar Legislative Council (MLC) to fulfill constitutional requirements following his election to the Rajya Sabha on March 16.
He is expected to formally assume his new role on April 10.
As per constitutional provisions, a member elected to the Rajya Sabha must resign from any state legislature within 14 days, failing which their membership stands cancelled.
In compliance with this constitutional mandate, Nitish Kumar submitted his resignation on March 30.
JDU MLC Sanjay Kumar Singh, who is popularly known as Gandhi Ji, on behalf of Nitish Kumar, handed over his resignation to Bihar Legislative Council Chairman Awadhesh Narayan Singh, and his resignation was accepted.
Nitish Kumar’s association with the Legislative Council dates back to 2006, and he served multiple consecutive terms (2006-2012, 2012-2018, 2018-2024, and 2024 onwards).
His resignation marks the end of a long tenure in the Upper House of the state legislature.

Notably, since becoming Chief Minister in 2005, Nitish Kumar has consistently held office as a member of the Legislative Council rather than the Assembly. With his entry into the Rajya Sabha, he will achieve the rare distinction of having been a member of all four legislative bodies—State Assembly, Legislative Council, Lok Sabha, and now Rajya Sabha.
Following this move, he will be required to step down as Chief Minister. However, under constitutional provisions, he can continue in office for up to six months without being a member of either house, during which he must secure re-election or adopt an alternative route.
Nitin Nabin resigns as MLA:
Meanwhile, BJP national President Nitin Nabin has resigned from his position as an MLA from the Bankipur Assembly constituency. His resignation letter has been handed over to Bihar BJP State President Sanjay Saraogi, who will submit it to the Speaker of the Legislative Assembly.
In an emotional message shared on social media, Nitin Nabin reflected on his two-decade-long political journey. He recalled being elected for the first time in 2006 from the then Patna West constituency, following the demise of his father, late Nabin Kishore Prasad Sinha.

He highlighted his continuous efforts toward the development of his constituency and expressed gratitude to the people for electing him as their representative for five consecutive terms. He also acknowledged the guidance of party workers and senior leaders in shaping his political career.
Nitin Nabin credited both Prime Minister Narendra Modi and Chief Minister Nitish Kumar for entrusting him with ministerial responsibilities, enabling him to implement key policies and development initiatives.
Announcing his resignation, he assured the people of Bankipur and Bihar that he would continue to work for their development in his new role within the party. He reaffirmed his commitment to contributing towards the vision of a “Development India” and a “Development Bihar” by 2047.
This dual resignation marks a crucial transition phase in Bihar’s political landscape, with both leaders stepping into new roles while continuing to influence the state’s governance and political direction.
