Patna January 4, 2025: Patna district administration has stated its intent to take action against Prashant Kishor for his unauthorized demonstration at Gandhi Maidan, an official said on Saturday.
District Magistrate Chandrashekhar Singh highlighted that the protest at Gandhi Maidan is not compliant with the 2015 Patna High Court ruling, which designates, Gardanibagh as the authorized site for demonstrations, provided prior permission is obtained.
“As per a 2015 Patna High Court ruling, Gardanibagh is the designated location for protests, provided prior permission is obtained from the district administration. Gandhi Maidan, a public space primarily used for recreational activities like morning and evening walks, is not authorized for protests or sit-ins Dharna,” Singh said.
Chandrashekhar Singh underscored that Gandhi Maidan is primarily a public space for recreation, and even political rallies there require permission.
The administration’s immediate priority is ensuring the peaceful conduct of the re-examinations.
Any legal or administrative action against Kishor will be decided after the re-examination process is complete.

Prashant Kishor’s defence:
Kishor argues that Gandhi Maidan, being a public space, does not require permission for peaceful protests.
He compared the situation to the large-scale farmer protests in Delhi, questioning whether those demonstrations were considered illegal.
Kishor stated he is prepared for possible detention and expressed his intention to resume the protest if forcibly removed.
He emphasized that the agitation will continue until Chief Minister Nitish Kumar agrees to meet with the candidates and address their grievances.
The protest is part of a larger agitation by BPSC candidates demanding the re-conduct of the 70th preliminary examination, with Prashant Kishor acting as a key supporter.
The administration’s restrained approach, coupled with Kishor’s defiance, reflects the underlying tension between procedural enforcement and public dissent.
The situation remains fluid, with the district administration balancing law enforcement with public sensitivities. The resolution of the candidates’ demands may hinge on a direct dialogue with the Chief Minister, as advocated by Kishor.
